What are the chances of being convicted of a weapons charge when there is no weapon? My son was arrested in June after an ex-girlfriend showed up at our home with 4 people, two(men) of which attacked my son when he arrived home.My husband and I heard the commotion and went outside.They all proceeded to scream at us as we told them to get off our property.My son, at this point, picked up a rock and threatened to break their car window if they didn't back off.They continued verbally fighting with us and my son broke the car window(s).The 2 men involved took off and when police arrived the girls said they were threatened with a hammer.There was no hammer, nor was a hammer found at the scene.The girls no longer wish to press charges but will not recant their story for fear of perjury on their own part.He was charged w/ 3 counts of aggrav. battery w/ a deadly weapon and domestic abuse causing bodily harm ( he never got near this girl).I can not afford to hire an attorney but was hoping somebody could give us advice.I have not been able to reach the public defender for which he was assigned and he's been locked up without bond for 4 wks. In all fairness, he was out on bond for a previous misdemeanor charge. He's no angel but I don't want to see him go to jail for years on bogus charges.
