    Default Can You Sue Your Ex-Boss for Making Up a Reason to Fire You

    My question involves labor and employment law for the state of: Ohio
    I was employed by a company.my boss terminated my employment. he fabricated a story to terminate me. I appeal his decision but my appeal was denied.
    I filed a law suite against the company but the company filed for Ch 11 bankruptcy. so because of Auto Stop my case was suspended.
    My question, Can I sue my boss personally?

    Probably not, since he was acting as an agent of the company.

    But sue him for what?

    I sued the company for Discrimination. Wrongful Termination, and Torsion. my boss gave me very bad reference. so I am currently unemployed because of his actions

    If it was a Title 7 action, there is NO individual capacity issue, just a company liability, if I am not mistaken. Was it Title 7?

    What is Torsion?

    I live in Ohio also, we have a reference law, I can link it if you want.

    Discrimination based on what?

    This was not a wrongful termination, unless the discrimination was illegal (not all discrimination is). A wrongful termination means a particular LAW was broken, not that you got bad references from your boss.

    it is under Tiltle 7.
    My boss gave very negative reference. also he submitted false info regarding me to the prospective employer, and many other institutions.
    Please give me the contact ifo of the reference lawyer

    I meant Breach of Contract not wrongful termination.
    Discrimination based on religion, and race.

    I did not mean a reference to an attorney for hire, I meant Ohio's employment reference law. Unless a reference is given outside what the law states, an employer is immune from civil liability.

    There are companies you can hire who will pose as a prosepective employer to see what the old employer says about you.

    Did you file suit on your own, pro se, or did an attorney file it? I am interested to know what constituted a breach of contract!

    Did you get a "right to sue" letter from the EEOC first befor filing suit, or was it filed with Ohio's Civil Rights Commission, the initial charge I mean!

    Thank you for the link.
    I received many feedbacks through Email which show what my formerboss did say on phone about me. those Emails sow falso info. about me
    My lawyer filed for me. I had a contract for 3 years. the company broke it.
    I got a letter from EEOC.
