My question involves an eviction in the state of: MA
I'm in need a legal advise and wondering what my options are. We've been having heated problems with our tenant for two years now and it finally came to a head two days ago. The lease is well expired so to me I believe she's now a tenant at will. Our problems began with her taking in pets. She now has 22 total cats and dogs and the entire duplex now has terrible flea and odor problems, no licenses or vaccinations for these animals. She's even now sneaking them in and telling her children to not tell us of this. She's caused a number of damages to the property and no matter how many times I've requested she stop using diesel fuel in the oil tank she continues to do so. A plumber advised me that it's now become evident that she's using nothing but diesel all winter long because excessive heat has caused our pipes and furnace to crack...diesel apparently burns much hotter than home heating oil. Two days ago she stormed into our home claiming our children broke into her home and stole belongings of hers. Police were dispatched, the children claim to have no idea what she's referring to. With lack of any evidence to support it I was in a situation where I do not point fingers unless I can prove anyone did such action. This made her very angry and she started yelling, swearing, and insulting us. I then said to her, "If she didn't like this she can just leave". She then gave me the finger, swore at me, and said, "Ya you just wait to see how long it takes to get me out". I believed this to be the last straw and now see her threat as a statement of none payment of rent coming for some time before I can get her removed. I self served her with a "30 Day Notice to Quit". That night after receiving it she then went to the police station wanting to press changes against our children for breaking and entering. The police came to our home the next day to inform us of this and he said to me, "It's strange to me how we were here yesterday and she made no mention of intentions to press charges but then once served with "Notice to Quit" she runs to the station to file a complaint." She also has a guest we have wanted out for awhile that we feel is most of the cause of our new problems, along with her bringing in all these animals and destroying the home. Can we get this guest removed? We've never excepted any form of rent from her and I was told we could file a trespassing warrant against her, or something like that. I believe if I can get this guest out then the tenant will soon follow. Without the rental income I have a very big fear that my wife and I could lose our home if this carries on.
I'm located in MA and wondering what process to take now? Should I retain legal services? The other issue we've been having is the neighborhood talking that she's been dealing narcotics (prescription drugs) out of the apartment. We were told her sign is to watch her porch light as it intended to tell her buyers if she's got anything. We've been taking notice that this does seem to happen some nights left on and others it's off, strange people coming and going.
New problem as of this morning. In the middle of the night she moved her van and blocked our families boat. She did this because she phoned the police at 1:00am claiming one of our children kicked her dog in the face. I woke up and just had to listen. She said to the police officer, "Are you telling me there is nothing you can do, then I'll do it myself"....what does that mean? Sounds like a threat to me. I believe she then moved her vehicle out of anger and just to be annoying and I know she will not answer the door if I knock and ask her to move it. Can I give her written notice, if she does not answer her door, that effective immediately tenant will now have off street parking? Tenant at will we can change to off street parking right? I don't want to go this road but what are my options if she's intentionally blocking us in with these antics?
