    Default MIP in California

    My question involves criminal law for the state of: California

    This morning at around 2:00 am, I got a MIP (25662 (a)) and it was circled as a misdemeanor. I am 19 years old and this is my first criminal charge (I had a traffic ticket that I went to traffic school for from before I was 18). Does anyone know of possible options for me to have this ticket not show up on my record (i.e. diversion program, community service, etc)? Also, if it is dropped down to an infraction, what would that mean for me? I think it would be unwise to plead not guilty because he tooks pictures of the can I was with. Also, I did not get breathalized, searched, or anything if that counts for anything.

    A first offense is punishable by a fine of $250 or community service of between 24 and 32 hours. Unless you are for some reason photographed and printed for this offense (and that woul be unusual) this will not end up on a state criminal history record. If dropped to an infraction, same thing. Yes, there will be a record of the conviction at the court house, and this would be available via a search for public records, but that's it.

    Yes, there might be a diversion program that will lead to a dismissal but that is something you might have to ask your attorney should you choose to employ one (which would be about 10 times the base fine of the citation).

    Ok, thanks! But I have another question, which I don't know if you'll know the answer to, but say I pay the fine or do the community service or whatever they have me do. When applying for jobs, would I have to put down an MIP for when asked if charged of any crimes? The reason I ask is because I am joining the Officer Program for the Marines and this could potentially disqualify me.

    If you are convicted of a misdemeanor, and they ask about misdemeanor convictions, you would have to answer "yes".
