If she wrote the check knowing that there wasn't money enough to cover it, she's passed a hot check. That's fraud, and that can get the account closed at best, her prosecuted at worst.
Put a stop on that check immediately.
Some people here answer questions when they do NOT know what they are talking about. You get what you pay for.
No, it is not illegal or fraud, There can be no prosecution. Stopping payment on a check makes no difference in any case.
Writing a bad check to pay a bill, rent, water, electric, telephone has no legal significance. The underlying bill is a civil matter, and if it is paid or not paid, is a civil matter. There is NO criminal recourse. Indeed there is no recourse at all for the check. There is only civil recourse for the original underlying bill. Stopping payment of a check in that case also makes absolutely no difference.
If you purchase services or merchandise and write a bad check, yes there is criminal recourse and civil recourse. If you do not have enough money and stop payment on the check, you can be charged with FRAUD, a criminal offense which is actually worse than issuing a worthless check and allowing it to bounce.
People who write bad checks and then stop payment on it who think that will let them off the hook for having a check bounce are total and complete morons. It just makes it worse if the other party knows what they are doing and go to the police.
I would guess from the bank's point of view a bounced check might be worse for the history of the account, but that can be explained as an accident, etc. while stopping payment of the bad check really does demonstrate fraud and criminal intent.
Stopping payment also speeds up the entire process. In the case of a bounced check, there are procedures that are followed to allow the issurer an opportunity to pay the check and avoid any criminal penalties. A stopped payment check will result in criminal charges much faster if the other person knows how things work.
However, being involved in writing a bad check to your own mom means you and your gf are total and complete scumbags and probably should go to jail just on principal.
