My question involves child support in the State of: Florida
My husband lives in Florida, and so does the mother of the child. My husband had child support determined in 2002. They have joint custody, but the mother claims her on her taxes. When child support was determined, this was his only child, and teh child was with her mother all but two days each week. He pays $425 per month and was current until the past two months, and is only roughly $300 behind, as he has been making partial payments. My husband now has two other children, and the money is really tough to pay right now. Although we used to only have her two days each week, in the past year, she is with us up to 5 days each week. Sometimes, even more. Her mother works overnight, so we have her all the time. The increase in having her, requires us to buy more food and clothing for her, which is tough as my husband took a pay cut to avoid losing his job. We have discussed seeking primary custody, but she is very close with her mom, and at 10, we have decided to wait for her benefit. Is there any way to have the child support amount lowered now that we have her all the time, and two other children? I heard that there was some law that was passed in October 2008 that stated something about paying no child support if the child was with the other parent at least 50 percent of the time. Any help you could offer wold be greatly appreciated. I would like to maybe try working through a mediator or something of the like.
