    Exclamation CVC 22350, Unsafe Speed for Conditions

    My question involves a speeding ticket from the State of: California
    Hear my story before I ask my question.
    One rainy day I'm driving along at 25 mph in a 25 mph zone in a residential area. I made a "sharp" left turn and while trying to recorrect myself back into my lane, I lost control of my car and ended up hitting the nearest tree head on. Keep in mind my car was about 20 years old and my tires had no tread on them. I also had no airbags so as soon as I hit the tree I lost consiousness for about 10 secs. I also had no time to slam on the breaks as I hit the tree. So I get out and look at my totalled car, look around and see nobody. So I immediatly call my towing company, AAA, who just happen to have to call the police to check on propertry damages before they can tow my car since I hit a tree on private property, even though there was no damage to the tree. Having been injured in the accident, I leave my friend with my car to deal with the police and the towing company. Three hours pass and the police finally call me while I'm still at the hospital to ask me a series of questions that I had no idea would incriminate me, such as how fast were you going before the accident? After the accident I was in quite a bit of shock and did not want to deal with the police, especially since I felt I had done nothing wrong so I tryed to make the conversation as brief as possible. When he asked me how fast I was going I told him I was going 25 mph because that was the speed limit. I really had no idea how fast I was going and theres always the possibility that my foot had slipped and hit both the gas and the brakes at the same time. But it all happened so fast that I cannot recall what actually happened. A month later I recieve a speeding ticket in the mail for unsafe speed for conditions. I retreived a copy of my traffic collision report from the police station and it is stated that they determined that speeding was the cause of the accident and that they determined that from my statement and from the officers visual observations at the scene.

    So with all this information, can you tell me what legal action I should take?
    I know I want to fight this ticket because so far I have nothing on my record, but I've taken driving school in the last 18 months.
    So if there's anything I can do to get out of this in trial, please let me kno.

    Traffic school?

    Seriously, losing control of your car because the road is wet is pretty much proof of itself that your speed was unsafe for the road conditions. Failing to properly maintain your car is not a valid excuse.
