    Default Juvenile Possession of Drugs and Paraphernalia

    My question involves criminal law for the state of: Ohio

    Alright, so my name is Sean, i'm 17 and i was recently pulled over near Cleveland, Ohio (where I live) for not using my turn signal pulling out of a state park parking lot turn only lane. Well, there was a park ranger whom i did not notice and not long after i made the turn he began to pursue me. I of course pulled my vehicle over. The unfortunate part is that i just happened to have 4 grams of pot and a pipe (with weed in it) sitting on my lap. The fortunate part was that because I couldnt find my lighter, i didnt smoke at all so i was not intoxicated what so ever. When the park ranger pulled me over i frantically tried to hide the loot inside my center console which was a stupid move on my part.

    So the ranger walks up, asks for my information and i give it to him. He then asked me to step out of the vehicle. Once i was out he told me that he pulled me over about the turn signal. However, he then asked me if i was hiding anything because he had seen my violently open and close my center console, he also said if i tried to lie her could easily get a k-9 unit. Knowing i was beaten I cooperated with the ranger and told him where the marijuana and pipe was. He didnt cuff me, instead he just told me to sit on the curb. After getting the weed/pipe and searching the rest of my car he thanked me for my cooperation and honesty and said because i didnt lie he was not going to arrest me, just right me my tickets. I ended up getting 3 seperate tickets, one for poss. of weed (way under 100 grams), poss. of paraphernalia (the pipe) and one for the turning signal. After the ranger called my parents he thanked me again for being cooperative and polite. He informed me that he was going to mention in his report that i was well mannered and cooperative. I also want to mention i have absolutly know kind of criminal record of any kind and I have a completely clean driving record. I just wanted to know if anyone had any clue what might happen. Should I try and see if the charges could be dropped in exchange for taking some type of drug rehad class? Could my driving be suspended? Basically, what should i expect? Thank you.

    possession of less then 100 grams of the ganja in ohio is a minor misdemeanor, fine of $100 dollars

    paraphernalia is a misdemeanor punishable by 30 days in jail and/or $750 fine

    drivers license is not suspended with the weed possession but the paraphernalia possession if convicted will lead to a suspension for 6 months to 5 years

    turn signal is a traffic violation

    get a lawyer for the best possibility of having the paraphernalia possession dropped in exchange for a diversion program or community service something along those lines and staying out of trouble for a given period of time

    definitely get a lawyer though

    If you are getting those facts from NORML, they need to update thier web page.


    MAX fine for a minor misdemeanor is $150.00, not 100.

    A Paraphernalia possession charge is a misdemeanor of the 4th degree, with only a MAX fine of $250.00, not 750.

    I have not looked for Cleveland, but a city can make POT possession of less than 100 grams any grade misdemeanor they want, not necessarily a minor misdemeanor charge.
