    Default Who Pays for Probate

    My question involves estate proceedings in the state of: Ohio
    I filed guardianship for my brother as a last resort. I am his power of attorney now, but his disability has become worse because he refuses "meds" etc.
    Anyway, my question is that I have to get him a recent evaluation and the cost of filing and possibly an attorney so I was wondering if I am allowed to use his funds to pay for this or even split the cost. Is there a standard for who is responsible. I might add that I filed the guardianship, but I am not seeking it at this point because he has become very difficult, so a court appointed one may be needed.

    Does your brother have any assets?

    A court may well approve the use of your brother's funds to reimburse the cost of the medical evaluation and filing fees, if the guardianship is granted and the court finds that it's in your brother's best interest. Reimbursement issues can vary at the local level, by local court rule, so you may wish to ask the clerk of the court where you've filed the petition.

    yes, he does have a savings account to cover cost.
