My employer relocated our family (Wife is a Green card holder) out of the US for what was to be a 6 month project. Now, we just past our 1 year mark - and after several trips back to the states for business - the last one we were informed on the 1 year rule. No Stamps in the passport regarding the 407, but hand written out for 10 months. After sitting and looking at the form i-407, trying to find a way around this, and reading all the threads regarding this matter - several questions come up:

1) Hearing in front of an Immigration Judge - What is this. If we try to enter, get caught on the 1 year deal, we would need to go in front of a judge - What happens at the port of entry to my wife - taken away until such hearing, or has to report back on a hearing date, but allowed to enter?

2) We are currently schedule to return back to the State in December (for good this time), if we turn in the card now, we would just be starting the whole process over again in hopes to have a new green card by December. Seems like I would be better to just write them a check and save everyone the time and hassle. Meeting with the judge allow us to bring up the employment aspect, as staying here was job related and not a personal choice of my wife - the family needed her here not in the States.

3) Any information on the hearing with an immigration judge at the port of entry would be helpful in making this huge life changing event.
