    Default Repayment of Credit Account in Default by Exhusband

    My question involves collection proceedings in the State of Texas:

    I was just served with papers regarding me being sued for a credit account that was assigned to my ex-husband in the division of debt in our Final Divorce Decree and it looks like he was still using the account before he defaulted payment.

    My name was the primary account holder and I surrendered my card at the final mediation. Why is he not being held accountable for this account and how to I stop the proceedings against me or do I have no defense on this matter.

    Who is ultimately responsible for this account and what will the court most likely do?

    Any help would be greatly appreciated.

    A divorce proceeding has no effect on the rights of the creditor to enforce the contract. All that means is that once you lose against the CC company, you can take your ex to court to recover some of the money.

    Remember- the CC company was not a party to your divorce, so the decision of the court is not binding upon them.
