    Default 17 Year Old Shoplifting in Oregon

    My question involves criminal law for the state of: Oregon


    Recently I was caught with stealing $380 of products from a grocery store (idiotic and weird, I know). I have to go to Juvenile Hall soon for an 'intake interview' where I'll be sitting down with my parent and reviewing the case and charges with someone who works there.

    I am 17, so I'm a minor and this is my first offense. The cop said this would go off my record when I turn 18. The cop also said I commited theft I, which is a felony but when my court summons letter came, it said I was charged with theft II.


    1. I was arrested, right? They didn't put me in cuffs and I was released at the store.

    2. What could the consequences end up being? Fines/community service/what?

    3. What's up with the cop saying theft I and the letter theft II?

    Since police were involved, yes, you were arrested. You were released on Recognizance. You will get a court order later for fingerprints and a mugshot.

    Theft 1 vs Theft II.....I can't answer that one.

    I would consult with a Criminal Defense Lawyer. He/She can answer questions the best. Many offer free 1/2 hour consultations.

    As for what you are facing: A Civil Demand letter in the mail. Pay it immediately. Court - likely fines and Community Service, possibly an anti-Shoplifting class or counseling, possibly probation.....it's hard to say as each case differs, each state and locality have different laws and sentencing guidelines, and different judges.

    Today I had my intake interview. The interviewer asked me why I did it and talked about the consequences. I was charged with Theft II and will not be going to court. Will I have to go back to court to get fingerprints and mugshots? The interviewer did not mention this at all.

    I'm on a diversion plan: I'm banned from the store, will write an apology letter to the store, will attend an anti-theft class that costs $45, will pay the court $5 for services and my parent is making me attend therapy starting next week.

    A civil demand hasn't come and since it's been about two weeks I'm doubting it will. The interviewer said it could come or it might not; I didn't sign any paperwork at the store so will I pay a civil demand?

    This charge will go off my record when I turn 18; I will have to go to the court to get my record cleaned and this will cost about $30.

    All things considered, my sentence is quite light and I have learned my lesson. My parent is furious at me and I know I've rightfully earned my parent's anger. Don't shoplift; it'll cost you more than what you take.

    It can take time to receive a Civil Demand Letter. Simply because it depends on the store/chains caseload.

    Regarding the diversion program: That's good news for you. Keep your nose clean (you do sound remorseful). What this program means is that if you don't re-offend, you have gotten off easy. If you re-offend, you will be prosecuted to the fullest for the first (and consecutive) offense.
