    Default Patent Reassignment

    I have a product that I want to bring to market, however there is already a patent on this product. The patent that covers my design had expired for non-payment in Feb 2006, and I am under the assumption from another source that the original patent holder has also "expired". What avenues are available to me to get a reassignment if such exists?

    As you probably know, you can't patent somebody else's invention. You're free to contact the original inventor to purchase or license any rights they may have to their invention, and to try to get a patent; but I suggest having the matter thoroughly reviewed by a patent lawyer before you make any assumption that you'll be able to get a defensible patent.

    "The patent that covers my design"... - are you talking about a design patent (a patent based on design, not functionality)?
