My question involves unemployment benefits for the state of Georgia. I was employed as a legal assistant for 3 years. I was in a hostile environment from day one and accused of touching another employee by stopping them from punching me in the side. A new employee came in one year later and bumped into me in the copy room and didn't even turn around to say excuse me. I did nothing, but that employee said that I walked past her desk and gave her the "bird". I then came down with high blood pressure from the stress of believing that I would be fired for her lie, I thought that my doctor visits was the reason. When they fired me 3 months later, I was not given a separation notice to advise me of the reason for my being terminated. I later found out through the DOL that it was for my conduct. The firm has given me a good reference to a potential employer stating that my work was good and that I would be re-hired, but they are now using Paralegals instead of legal assistants. Two of the partners also gave me endorsements stating that my ethics and moral conduct was worthy of being a notary public for Fulton County prior to this incident in December.

Can I be fired for my conduct, but then rehired if they had a position? Isn't this a contradiction? Was I not supposed to receive a reason for my being fired at the time of termination?

I am waiting for a hearing date, which I requested be in person. No one saw me do anything like this and I have been working for over 40 years with no such incident ever happening before. What are my chances of winning over these lawyers when all of this is simply hearsay and personal dislikes?
