    Default Pretrial Diversion and Deferred Adjudication

    Can someone please tell me the difference between a pretrial diversion & Deferred Adjudication??? My lawyer wants $750 here in TX & is not even sure she can get me the diversion. I really don't understand the difference. My shoplifting "mistake" was $63.

    Deferred adjudication means that the finding of guilt is deferred by the judge, even though there is enough evidence to have found the offender guilty of the offense. I believe the offender has to actually enter a guilty or no contest plead for this option. No conviction.

    Through a pre-trial diversion program, the offender is given the chance to avoid prosecution of an offense. In most cases, no guilty or no contest plea is required. No conviction.

    Pre-trial diversion is better if a guilty plea is not required.

    If it is a weak or a VERY minor case, a pre-trial diversion may be offered. For example, if the dollar amount is very low. On the other hand, if the amount is not low and/or a knife/scissor/tool was used to cut off security tags, diversion will not be offered.

    If pre-trial diversion is not available, deferred adjudication is your next best bet.
