My question involves a security deposit in the State of: Nebraska

Deposit Amount : $1595
1yr lease, From July 1st 2008 to June 30th 2009
May 29th : Date i recieved the 2yr lease extension papers
June 2nd : Date i asked about issues of 2yr lease
June 2nd : Date the agent assured me i should have no worries
June 12th : Date the agent told me the the owners rescinded the 2yr offer
July 14th : Agent gets nasty about security deposit.
NE Law : 14 days for Security deposit return / itemized list of damages
NE Revised Statute 76-1416

Here is an interesting one. i also have proof of all these converstations
and dates/times in email, thats the only way i talked to the agent for
4+ months.

Earlier in the year i asked if a 1 or 2 year lease extension would be ok.
The management company contacted the owners and they agreed.
I then eventually received the paperwork and notified the management
company i had some issues about signing a 2yr lease if they were never
in the office. June 2nd I was then assured by the agent i should have
no worries about the 2year lease. June 5th thru 9th i had contact with
the agent about other items. June 12th @ 12:20pm i receive an email
stating the owners have "rescinded" the 2yr lease offer and now want to
sell the home. June 12th @ 4:03pm i tell them i do not want to buy the home
and that i will be out of the home by the end of the lease date.
Between June 16th and June 30th there were converstations.

June 29th i notify them i am out of the house and asked when would they
like to do the walk through.

June 30th @ 10:06 am the agent thanks me for cleaning the house upon
leaving and notifies me they don't do walk throughs with the tenants.

July 1st we both agree my office address is where the deposit will be sent.

July 2nd the agent lets the carpet cleaners into the home.

July 10th i request the status of my security deposit or a itemized list of
damages and the remainder of the deposit.

July 13th no mail or email.

July 14th no mail or email. I have my girlfried (also on the lease) call the
business to inquire the status of the deposit. At this time the agent becomes
angry and stated they can charge me 10 days worth of rent and utilities
primarily because i gave no 30 day notice.

July 16th i visit a lawyer, and he informs me i should take them to small
claims court, which i have the paperwork on, not yet filed.

July 17th, STILL no written document of what my deposit it being held for
or when i can expect to see the remainder of it.

The Nebraska Statute 76-1416 states : the balance, if any, and a written
itemization shall be delivered or mailed within fourteen days after demand
and designation of the location where payment may be made.
It also states : that, if the landlord fails to comply the tenant may
recover the money due and reasonable attorney fees.

Should i go back to my attorney and have him do the work anyways since
according to the law they broke, they would be paying the fees?

I have 79 pages worth of emails back and forth and all these things outlined
that prove the landlord is in the wrong, besides breaking the landlord-tenant
law on Security Deposit returns.
