    Default Felony Probation Violation and Underlying Sentence

    I HAVE A PROBATION VIOLATION,WITH A 54 MONTH UNDERLINING SENTENCE.ITS ON FORGERY CHARGES FROM 2000.I WROTE CHECKS IN 3 COUNTIES,GOT PROBATION IN 2 AND WENT TO PRISON IN 1.I DID MY TIME,GOT OFF PAROLE EARLY I HAD PROBATION IN ALL3 COUNTIES 2 I COMPLEATED AND THE 3RD EXENTED MY PROBATION DUE TO A PRIVOUIS VIOLATION,I LIVE IN A SMALL TOWN AND SOMEONE WAS PASSING BAD CHECKS AND SINCE I HAD A HISTORY OF THIS THEY STARTED HERRASSING ME TO THE POINT THAT I WAS AFRAID TO REPORT.WELL THEY ARRESTED THE PERSON THAT COMMITED THE CRIMES, BUT NOW I STILL FACE THE VOILATOIN IM SO WORRIED THAT THEY CAN MAKE ME DO MY 54 MONTHS OF UNDERLING SENTANCE IT IS MY SECOND VIOLATION.I JUST WANT THIS ALL BEHIND ME.ALSO MY FIRST VIOLATION WAS DUE TO MY PROBATION OFFICER TRYING TO SEND ME TO DRUG TREATMENT THAT I REFUSED, I HAVE NO PRIOR DRUG HISTORY PASSED THE ASSESSMENT AND HAVE NEVER FAILED A UA IN MY LIFE. THE JUDGE EXTENED MY PROBATION 18 MOS THE 1ST TIME.IS THERE ANY GUIDELINES THEY HAVE TO GO BY? IM ONLY ON THE LOWEST FORM OF PROBATION,ADULT PROBATOIN.PLAESE HELP ME.

    Default Probation Violation

    If the only basis for the new probation violation is the passing of bad checks, and it has been established that you were not the person who passed the bad checks, presumably you will not be violated.

    I ALREADY VOILATED FOR NOT REPORTING,BECAUSE I WAS AFRAID TO REPORT AT THE TIME BECAUSE, THEY HADNT CAUGHT THE PEARSON RESPONSABLE AT THE TIME. THIS HAS BEEN A YEAR AGO.SO WHAT I REALLY NEED TO KNOW IS WHAT THE GUIDELINES ARE IF ANY AND WHAT WILL HAPPEN WHEN I GO TURN MYSELF IN.DONT THEY HAVE TO USE OTHER OPTIONS LIKE COMMENITY CORRECTIONS BEFOR SENDING ME TO PRISON.

    I would like to know if there are any guidelines that that they have to go by,andwhat they might be?Someone had mentioned something about an IMPP,but what i could find there did not pertain to me.Also on both violations i felt that I was forced in a corner by my probation officer, how can they do those things to people and get away with it!Like I had mentioned befor the first violation she all the sudden said that I had to go to inpatation treatment for honestly no reason, I had a good job,had just made managerment a few weeks prior,I had a nice apartment, everything was going great,and i have no reason to tell you you any different, I was not doing drugs!I have never had any drug charges,Ive never in my failed a UA in my life ,and she said I had to give up my manger postion, my apartment, and everything I had worked so hard for,and check myself into inpataint treatment, I refused. So after going back to jail and in front of the judge,he reinstated my probation,and gave me 18 more months.Now here I sit again after her, and a detecctive who I must mention is one of her good freinds. I might add where bound and very determined to hem me up on checks that I had nothing to do with,I knew if I went to jail under those circumstances that I would be convicted of these crimes, so once again I felt I had no choice.I havent been in any of my own trouble since I got out of prison in2002.Im a mother and a grandmother and I got in trouble one time at the age of 40 and I do not belive how this system works! Also I want to add that when I violated the first time I had already done all my court ordered sentance on probation by almost a year, I was only still being supervised because I had not payed off all of my fines and court cost.
