My question involves education law in the State of: Arizona

This question involves paying back a RN tuition assistance plan from a local hospital. My wife applied for entry in a two year nurse training program sponsored by a local hospital. Under the agreement the hospital pays for the students tuition and books and the student agrees to work for the hospital for two years after completing the program and passing the RN test. She signed a contract which stipulated that she would have to pay back the $10,000 if she did not complete the program or the employment commitment.

We were told that the program is designed for students new to nursing and that experience was not a requirement. We were also told that she could volunteer at the local hospital to gain experience in nursing before starting classes. Neither was true. She was the only student in her class without a medical employment background. The classes assumed a medical background and was taught at a level that assumed such a background. She had tried numerous times to volunteer at the local hospital but was denied each time. In short, this strait A student failed out of the program in only 6 weeks.

The hospital paid the University the cost of the entire program of $10000 and now we have to pay despite only 6 weeks of the two years. They will not negotiate or listen in any way to the above concerns. They refuse to let us have credit at the school for the other semesters so that she could go back at her own pace.

I just don't feel that they were honest with us and am seeking advise on what rights we have and if it is worth fighting. What area of law is this and what type of lawyer should I seek.
