    Question Pretrial Release Procedures

    If a person has been arrested and has been booked and is sitting in jail, how long does the judicial system have to charge them before having to release the person?

    I have heard that if you sit in jail for 45 days and have not been charged, you would then have to be released. Is this true? Any help would be great thank you!

    Bond has been set? Then you get to post bond and can get out at any time. There are people who spend a lot of time in jail before they go on trial - we don't let a "Ted Bundy" out after 45 days merely because it takes a long time to start a capital murder trial.
