    well, thats the thing, the vice unit that found him with all of this stuff basically walked into his house, with his permission, and searched his entire house,again, with his permission, and found all of the before stated stuff, so how would he be postively "not guilty" of this, I mean, I know it just procedure, but how could someone be "not guilty" with all of the evidence against them?

    first of all why the hell would he let the cops search the house if he knew there were drugs present????? make the cops get a search warrant....

    well he's not positively not guilty but the law assumes all people are innocent until proven guilty... so why not take advantage of that and make the state prove your friend is guilty

    however with this type of evidence a trial would be very costly and most likely result in a guilty verdict (unless your friend gets an incredible attorney) and there's not way of saying for sure what the verdict would be

    once again your friends best bet is to listen to what the prosecutor has to offer in terms of a deal... and to HAVE AN ATTORNEY PRESENT

    he has one, but I dont know of his track record with these type of cases. The only thing that I find slightly odd is how cheap his lawyer is, kind of odd, esp in this case

    It's not always the price but important to make sure that he has a good lawyer. It's common gonna place to plead not guilty even when it's obvious that you are. Then in most cases your lawyer works out a plea bargain to a reduce charge. If he just pleads not guilty and get sentenced he going in there blind.

    Was his priors drug reacted,the pills might hurt him more,25gs isn't really that much weed. Here in NY that's probably just a misdemeanor. It depends how strict the local da and judges are. His lawyer should be able to give some sort of guess what he is look at, the da should offer him a plea bargain. I think if there is a chance for probation with a good lawyer. If the county he in is strict and he has priors especially related to drugs then probably looking at some time in jail. Regardless prior related to drugs are gonna look bad on him. If he has a prior felony he might be looking at increased time.

    florida in genaral is very strict when it comes to weed, more than 20g is a third degree felony. My friend has a pre trial conferance with a judge, who knows how that will go

    It all depends the county like palm beach and broward are not as hard on you but plain and simple prison time is most likely what hes is looking at. I mean you can try to go threw (drug court) which is his best option but he will need a good private attorney. Also he could get county jail time with a few years of probation. he gave them permisson to search so he cant fight it with probable cause and his best bet is to keep pleading not quilty and push it off as long as possible (a good attorney will help with that) the longer he pushes it off and pleads not quilty the state will offer him a plea. (if he keeps pushing it off the state plea dropes to less time/ probation. I've been threw this before.

    I think he has too many prior offenses for any sort of "gimmie" the state may offer. He is too dumb to remain "clean" while on probation. For example, most of his misdomeanors were for boating/road vehicle violations, but instead of changing his behavior, he kept doing the same thing, and kept getting popped for the same thing within a few months

    Yeah it really depends how strict the county is, like the other person said a good lawyer could reduce the amt of time,maybe he does 6 months to a year in county,instead of state time. Maybe he could get in a boot camp or something like that,spending a year or so behind bar might be the only way he is gonna act right. The priors are gonna be bad but if there not drug he has a chance. He seems like an idiot but not some hugh drug dealer,the amt of weed isn't that much,that plus the pills look bad. He wants to try and avoid state time. Did they offer him an plea bargain yet?

    In your friends case, the quality of the lawyer isn't going to make any difference. There are no legal arguments to make, no exclusion of evidence is going to happen. There is really nothing for a lawyer to do other than to make a deal.

    Any deal depends on the lawyer having something sympathetic to sell to the DA, or something that will make the DA want to agree to a deal, and having a reasonably good realationship with the DA.
