    Default Room Occupancy

    I'm not sure if this is the best area to post this but here we go:

    I am wondering how many people can occupy a room, or how many people can occupy a 2 bedroom apartment. If known, what are the age limits, sex, and everything else that is helpful.

    I figure this kind of neglect because if there is a law, you are going against it, then it needs to be brought up to the court, etc.

    I couldn't find any information for California on this subject.

    First, there are probably limits outlined in the rental or lease agreement for the space. Violations of those agreements can result in non-renewal or even eviction proceedings.

    There are also usually fire codes that address such things - but that's a question best answered by the code enforcement office for the city or county in question. Such limits and guidelines of x people per y square feet typically occur at that level and are enforced at that level.

    If you're asking because of children being crammed in, there's not a set number (so long as those numbers are otherwise not problematic as outlined above) and each case would be evaluated based on living conditions, the ages and genders of the children in question, etc.

    As a landlord and a mentor to the Landlord group here. I'd say consult fair housing laws. The old "two persons per bedroom" rule was found to be discriminatory. Many cultures such as Latino and Pacific Islanders live with many members of their extended familes under one roof. Who's to say a dining area can't be a sleeping area? A sleeper-sofa in a living room makes that a sleeping area. I'd be careful.

    yeah, that's why i'm asking first before possibly bringing it up in court. my husbands ex has 2 other bio children, and a step son. the step son 14 is sharing a room with the youngest boy 6. and the baby is sleeping with mom and dad. if husbands ex wants to have my step son live there, my question would be "where would he sleep"? in a double bed with step son and youngest son. they don't have bunk beds... i wouldn't do that for my children, sharing rooms yes, but not beds and i would have enough rooms to fit the children comfortably.
