    Default Alimony

    My question involves divorce in the State of: AL

    After he was having an on and off again affair, my husband of 10 years walked out and his girlfriend sent me divorce papers. Our car was in his name yet I paid every payment and he only worked 3 yrs of our marriage. I am retired on disability after working 34 yrs. Is there any way I can get alimony from him, or even her because she caused the divorce? I supported us on my limited income. Thanks

    If you request spousal support from your husband and were married for at least ten years, the judge from the divorce court, at his or her discretion will consider:
    • the value of each spouse’s assets as well as their families', and
    • up to one half of any pension, 401k or retirement benefits.

    Marital misconduct by either spouse (such as your husband's affair) may be considered in determining an appropriate support amount. Any property acquired prior to the marriage or by inheritance or gift may not be considered in determining the support amount. (See the Alabama Code, Title 30, Chapters 2-51, 2-52, and 2-55).
