    ok, I'm gonna sound like a bitch here.

    Grow up, take responsibility. You've apparently worked there for a long time, which meant you knew they had no water fountain. Therefore, you could have had the common sense to have brought a beverage with you in the first place.

    There are rules to be followed.

    You may think you followed them in talking to your manager before getting the pop. Guess what? This is the real world. Your manager may be thinking in "Me vs Him"/"Cover my own butt" mode. It's not right, but it is what you will encounter in the workforce.

    Go move on....find another job....because with each day that passes, it's obvious that you are likely not returning to work there. Maybe they are trying to force you to quit. Who knows? But at this point, if you are worried about money....best to get off your butt and start job hunting.

    PS: Please do yourself a favor....go see a lawyer with all your questions. We've done our best here, and we are not lawyers.

    this thread has served its purpose and run its course.
    its now just banter of opinions the legal questions have been answered to the best of the members abilities.

    I do not see how it was theft. A manager (who is an agent of the employer) gave the OP permission to take the soda. At this point, if the employer has a problem with that, they should take it up with the manager.

    It seems to me that the manager may covering his/her own ass here. "If I speak up for him (Rob, right?), I'm in trouble". Let's face reality...most are gonna cover their butts first.

    Maybe he can get a lawyer to ask for the LP tapes, and hope they show him getting permission? This would be best discussed with a lawyer.
