    Default Caught Again

    My question involves criminal law for the state of: Georgia

    So a couple of days ago I was in a large department store and stole a pair of sunglasses, unfortunately I have stolen and been caught by this store before, in total this is my fifth time being caught stealing. Well this time when I left the store I noticed one of those store security rent-a cops goons walking behind me, so I took off running, I am a small girl about 120 pounds and he must have been over 6 feet tall and about 200 pounds, when he caught up to me he throw me on the ground. He used really excessive force and left a bruise on my arm. He was about to handcuff me when I slapped him across the face and called him a thug, I was about to slap him again because he was on top of me in a really intimidating way, when he grabbed my arm and handcuff me, I was yelling for him to get off of me and trying to spit on him (might have not been the best thing to do.) He took me back to his office were he was really rude to me and would not take off the handcuffs after all I was crying and told him they are hurting my wrists. He told me they were not built for comfort, and made other comments about how stupid I was and how I was acting, the way he treated me was appalling and I told him I was going to sue the store because of the way he was treating me. The police were called and I was arrested, I told them how badly the store goon treated me and they just laughed, also they asked me some questions but never read me my rights.

    My question is what are the chances the charges will be dropped because the police did not read me my rights and because the store goons were highly unprofessional and mean to me? Also if the charges are not dropped can I claim a medical problem because I have been stopped shoplifting and I have a sickness, could I claim I am a Kleptomaniac.

    You're kidding, right? You don't really expect them to be NICE to you, do you? You steal, and expect...tea and cookies?

    Be grateful they're not pressing assault charges on you. Of course, they still might. He was doing his job - catching and detaining a thief - and you assaulted him. That's not going to look good for you.

    You can certainly have your lawyer try to argue that you weren't read your rights, but I wouldn't count on it getting the charges dropped, given that you've been foolish enough to steal from AND get caught in the same store multiple times.

    Also if the charges are not dropped can I claim a medical problem because I have been stopped shoplifting and I have a sickness, could I claim I am a Kleptomaniac.
    Not the proverbial snowball's chance. Lying to the court will get you in even worse trouble - and unless you've been formally diagnosed based on DSM criteria, that's exactly what you'd be doing.

    Might get you ordered into therapy, but it's not going to get the charges dropped.

    As well you should be. You need a lawyer, and I suggest you get yourself in to see one fast. If you cannot afford private counsel, show up for court and ask for a Public Defender.

    If you'd like to NOT find yourself in this situation in the future, you need to stop stealing.

    Honey....you help....both legally, and mentally. I recommend a lawyer and also a psychiatrist.

    First: The "security goon" was doing his job, which is to catch shoplifters. You slapped him, you spit on him....you are so lucky you are not getting multiple Assault charges. Yes, spitting is assault.

    You think the "security goon" treated you horribly? How would you feel if someone slapped you, spat at you? Oh, but you got a bruise on your arm while you were fighting the guy.......I'm sorry, but I have no sympathy. And I don't think a jury or a judge will, either.

    You fight the guy and assault him, and you want him to take off the handcuffs because you are crying? Um...hello? You've assaulted the guy, he had every right to put you in cuffs and not take them off. Sounds like you would have tried to assault him again if you had the chance.

    5 times caught shoplifting? And some from the same store? Do you have a braincell in your head?

    Again....go get a lawyer and a shrink. You need both.

    One more thing, Klepto:

    I'd watch your attitude in court. The judge does take that into consideration.

    Considering this was her fifth time stealing from the same store, I am pretty sure the attitude train has left.
