    Default Credit Card Purchase

    My question involves collection proceedings in the State of: CA

    I purchased a camera lens on my credit card for a friend so his spouse would not find out. I know bad idea to start. He agreed to pay it off in 4 months PLUS interest. The sales guy and another person I know were there as witness not knowing this was going to go bad they just happened to be present and give me a hard time for buying a $1,800 lens for this guy. 4 months went by and I have not seen much of this guy. We would see each other almost daily if not a few days a week. Now I don't see him. He went to france with his husband after four monts of not paying. In the begininning I paid the minimum to keep it in good standing. He then bought a big screen tv and bragged along with a laptop and a few other things. I went to him and asked. He gave me 100 dollars. and would give more when he could do it with out his husband finding out. They went to Colorado together and bought a hand radio for HAM. I confronted him and he said he would take care of it. I got pissed and quit paying told him it's on him. He blew it iff for months so the interst and late fees went nutty. It came to $2700 and climbing he said that wasnt fair and we had to do something about it. I toold him thats what happens when your late. Now you have a 33% interest rate on a daily balance. He took off for a few weeks and refused. Eventually I cornered him and explained the situation to him and he states he's not responsible for the interest and late fee that thats my fault. So he tried to pay me th original amount with a check if I cashed it had paid in full written on the check. I wrote him with the two witness and I'm now taking him to court. Do I have a case?

    I don't think so, not for the penalty rates, unless that was a part of the agreement. The penalty rates are a part of YOUR agreement with the CC company, and he is not bound by that.

    Furthermore, you bought an item for a guy who is willing to lie and deceive his spouse, all on a handshake? This guy doesn't respect his vows to his spouse, and you expect him to respect you? Then you compound it by destroying your own credit when you stopped paying the CC?
