    Default Excessive Fine for Speeding in Snohomish County, Washington

    My question involves a speeding ticket from the State of: Washington

    I recently got a speeding ticket in Snohomish county, WA. This was for doing 19 over LIMIT. Regarding this I have a few questions.

    1. The citation states I was booked under 46.61.400.19. I figured out that 46.61.400 is the statue code, but what is .19? Is it the excessive speed that was recorded?

    2. The fine was for $175/-. This is more than 2X the penalty mentioned inIRLJ 6.2. The location was not in a work zone. However, there is a nearby school zone, but I am pretty sure the school zone was not in effect (the school zone lights were off). But, does the school zone explain the >2X penalty? If yes, will there be a reference that in the citation. No other statue code other than 46.61.400.19 have been quoted. Will a statue code be cited if there is a school zone violation?

    Yes, the .19 is probably the speed over the limit. As far as IRLJ 6.2 is concerned, it simply defines the "monetary penalty". But, if you'll notice, the third sentence in paragraph (a) starts out, "Provided that, whenever the base penalty plus statutory assessments ...." It's those pesky "statutory assessments" that cause the fine to more than double. $175 is the correct total penalty for 19 over in a speed zone that is over 40 (if it had been under 40, the penalty would have totalled $195). You can find MOST of the statutory assessments by looking through RCW 46.63.110. There are others....

    Honestly...why worry about the fine until you've had your day in court? You should start the process of contesting it by requesting a contested hearing and requesting a discovery. If it's not something you want to deal with yourself (I think you should! Lawyers don't use voodoo...) one of my friends got a ticket dismissed at www.beatyourwaspeedingticket.com with help from an attorney for under $100 which is still cheaper than $175!

    Just today I got pulled over heading WB on SR 2!
    I was going 20 over in a 40 zone and am fined $200
    I still need to figure out how I should handle this, so frustrating!
    Have you had your court date yet? Any success/ advice?
