    Default How Long Will I Have to Wait to Have My Class C Misdemeanor Expunged in Texas

    My question involves criminal records for the state of: Texas

    I have been arrested twice. The first Time I was arrested for possession of marijuana 0-2 ounces which was a Class B Misdemeanor but my lawyer had the charge reduced to a Class C misdemeanor Drug Paraphernalia Charge for which I was convicted. The second arrest was for theft 50-500 which was reduced to a class C misdemeanor and I was put on something called a special expense to where I would wait 90 days without getting into trouble and the court dismissed my case.

    About a week ago I went to court to have my Theft Class C Misdemeanor sealed off of my record. The Judge granted the petition for nondisclosure but the court could not enter it into the system because my case was a special expense and not a regular deferred adjudication. They recommended that I wait to get it expunged off of my record.

    My question is how long do I have to wait to have my theft charge expunged off of my record and what are the processes of doing that?

    From what I can see, you can petition immediately.

    What's "special expense" - do you mean "special dispensation"?

    The Special Expense was a thing to where the judge told me not to get in trouble for 90 days and I would be able to come back and get my case dismissed. It is different from deferred adjudication because I didn't have probation or anything

    Can I petition for an Expungement Immediately?

    I have a similar case like yourself, you would have to wait for the statue of limitation to end which is 2 years after your arrest date. Then you will be entitled to file a petition for an expunction on your record.
