    Default Caught Shoplifting at Walmart

    My question involves criminal law for the state of: CALIFORNIA

    I was recently charged with PC 484 in CA (San Jose/Santa Clara County) after shoplifting $168 from Walmart. I was honest, respectful w/ Walmart and police officers. This is my first criminal act. I was cited w/ a misdemeanor and released. The officer fingerprinted me, gave me a ticket and I have to appear to a court date in 2 months. Before that he said that I have to go to the court office to get my finger printed there again since I was never booked. What will happen there. Will I be arrested? Jail time? Drug Tested? Fined?

    The officer also told me about taking theft classes so that may get my case dismissed. Can I get this reduced to an infraction? or even expunged/dismissed?

    ALSO: The ticket that the officer gave had something that read ''Without admitting guilt, I promise to appear at the time and place indicated below. Signature x'' However, after I was release I looked at the ticket and it wasnt signed. The officer never gave it to me to sign. the next day he called me to come meet him to sign paper work otherwise there would be a warrant out for my arrest. However I was out of town and he is suppose to call me back today. He never did. What does this mean? What will happen?

    You already were.

    Jail time?
    While it's certainly on the table, it's actually pretty unlikely. You really have to behave badly in court to see the inside of the jailhouse for misdemeanor theft.

    Drug Tested?
    Maybe. Probably not, though. If this is a concern, stop hitting whatever you're hitting.

    Fined?
    Most assuredly. You're probably going to get a letter in the mail from WalMart with a Civil Demand - a civil fine they're legally permitted to collect.

    If you get it? Pay it. If you don't pay it, they can sue you for it, and trash your credit with a judgment.

    You may qualify for diversion, yes. It would be in your best interest to consult with an attorney to see what you need to qualify for this.

    Can I get this reduced to an infraction? or even expunged/dismissed?
    Possible, but not terribly likely.
