My question involves criminal law for the state of: Georgia
I was charged today for shoplifting. I don't believe there is an amount value attached to the charged because I was charged by loss prevention at the store for taking too many free samples. A sales rep and brand rep verified that these samples were free. I did take more than one of each, because I wanted to take a sample of each back to a family member. Is there a law that prohibits taking too many free samples? The store manager didn't know how to assign a value to them because they were for free distribution to all customers. I understand that so many would equal a full product, which would be theft, but there were not enough samples to make up a full product of any of the products where samples were offered. The samples were makeup, and the were stamped on the sides as well with "FREE SAMPLE - NOT FOR RESALE". I plan to get an attorney, but even the arresting officer said this was the most ludicrous shoplifting charge he has heard of. Any suggestions, comments, knowledge of any product sample laws out there? Can/have shoplifting charges be dismissed in a case like this?
