    Default Naming Baby After Father

    My question involves paternity law for the State of: Michigan

    My boyfriend and I are expecting a baby boy in Sept. We would like to name the baby after him, as he is the third, the baby will be the fourth. The problem arises here: I did not give the state the father's income information when I was filling out my paperwork for medicaid, and now I am concerned that the state will come after us for medical costs if I put him as the father on the birth certificate even though we are not married. We do live together, but we split the bills and he does not support me. Do I need to refile my medicaid application and give his information, or can he be put on the birth certificate without penalty? I know nothing about the law in this area, or in general for that matter, so any information on my situation would be greatly appreciated.

    Are you telling us that you deliberately committed welfare fraud? Then consult a criminal defense lawyer. If you're telling us something else, please elaborate.

    Sorry, I guess I could have been a little more specific. At the time that I first found out I was pregnant and applied for medicaid my boyfriend and I were not living together. Since then, he has moved in with me. I know that in Michigan the only way to give the baby the fathers last name is to have the father sign the AOP. So, since I already have medicaid do I have to reapply now that he is living with me or can he just sign the AOP after the baby is born?

    You can give the child the father's surname without naming anybody as the father. If you want to name your child Jimmy Happy Sunshine, nobody's going to stop you.

    But if you're supposed to be telling the welfare authorities that the baby daddy has moved in with you, do it.
