    Question Judge Dismissed My Case, Lawyers Still Calling

    My question involves criminal law for the state of: California

    I was caught shoplifting at Walmart on Feb 28. I showed up to court, got a public defender, got booked and released, showed up for court 2 more times. Then on the day of my jury trial, I showed up, they continued it, I got put on phone stand-by. Case got continued again, and third time I got a call from my PD saying a judge dismissed my case have a nice day earlier this month. Walmarts lawyers have been calling me since March. They called the day my case got dismissed, 4 days later, and then nothing for 2 weeks. I figured I was good, they called again and now I don't know.

    Can they do anything? I know if I call they will say I owe them money, but do I? Should I call my ex-PD?

    They're calling about what? An unpaid civil demand?

    They leave a message saying. "PLease call this number about docket # whatever." They cranked up the calling, they've called 3 times since I posted this. One of them was on the 4th of July.

    You're being called by a collection agency. Unless they sue you, win, and get a judgment against you...you owe them nothing. I'd suggest you TOTALLY ignore them. If you do, they will soon stop calling you.

    If they're a collection agency, you can send them a letter instructing them not to contact you again. If this is a civil demand situation, that could potentially trigger a lawsuit.

    Interestingly, I heard an experienced attorney discussing this very subject on KGO radio (San Francisco) yesterday. The maximum civil award in California is 500 bucks plus the cost of the stolen items if they were damaged. The collection agency probably gets half so we're already down to about 250.

    On top of that, someone's got to show up in person in small claims court (and win) and the chances of them being in California, much less in the same area, are quite small. Further, he said the only other costs that they can recover are the amount of the filing fees (about 25 bucks...which they've already 'shelled out').

    I think, without encouragement from OP, they'll soon stop calling and move on. That was the attorney's opinion and I find it easy to agree with.

    If it is a collection agency, you can instruct them to not call you again. Keep written record of when they called, their number, name, etc.
