    Default Getting Restricted License After Second DUI

    My question involves a driver's license issued by the State of: CA

    Is it possible at all to get a restricted license after having two dui's? The DMV has in their records that court charged me for one dui case, (they were both within 10 hours of each other, 2nd one was when I was hung over and still blew over....)

    Is it at all possible that the DMV will issue me a restricted license. My counselor for my dui classes says to call the dmv every other day and ask if i can get one. She said one of them will eventually say yes. Its been little over 6 months since my license was suspended.

    Was your license suspended pursuant to a court order or was it a procedural suspension by the DMV?

    If it was court ordered then the only way the DMV would be able to issue you a restrited license for you after you have a court hearing and assuming the Judge allows it.

    If you had an attorney handle your DUI cases, he/she can answer your questions more specifically.

    my license was suspended by the DMV, the court didnt give me any penalty for my license in my Minutes or whatever its called paper. Only the dmv has handled my license suspension

    What vehicle code section were you charged with/convicted of?

    I can tell you that your counselor is wrong about "keep calling and one day they'll say yes" just because you called too many times... as there are specific guidelines for how, when and why they will issue a restricted license.

    Post information about your case (VC section, how long your suspension is for, how long ago were you convicted... etc) and I might be able to find some definitive answers.

    Otherwise, you can call the DMV and they'll tell you.

    If you have one prior DUI conviction, admin per se suspension or alcohol-related reckless driving conviction in the past 10 years, your license will be suspended for one year and you are not eligible for a restricted license. If you refused or failed to complete a chemical test after being properly admonished of the consequences, your license will be suspended for two years.
