    State is MI. MUST I sign a RELEASE to get my final check?

    Just some "standard form" they have when someone is parting from the company. There is a dispute about wages that are owed to me - but I think they have everyone sign it even if there is no dispute. I'd rather not sign it and want to know if I really have to.

    There's no law that says you have to, no.

    I'm not where I can look up when final pay has to be released by in your state (I think it's next regular payday but I won't swear to it till I can confirm it) but whatever time it is, if your employer does not release your final check, release or no release, by that time you can file a complaint with the state DOL. They have no right to hold wages for hours worked waiting on a release form. They might be able to withhold unused vacation time or severance until you sign a release, but not earned wages.

    Yeah - I think they're gonna' try to hold me over a barrel and call it severance - but it's really wages (Salary, commission, bonuses). Any thoughts?

    As I already said, if they do not pay you wages for time worked by the appropriate date, you file a complaint with the state Wage and Hour division.
