    Question Ramifications of State Paying in IOUs

    In California...
    My X-husband works for a non-profit organization that receives the majority of their funding from the state. If/when the state issues IOUs to his employer starting July 1st the company will not be able to make their payroll and he will get an IOU.
    Will this change his obligation to make his regular spousal/child support payments in full and on time to me?

    It's my understanding that IOUs cannot be used for salaries anymore - in 1992, more than 93K California workers were issued IOUs in lieu of pay, and a Federal judge ruled that such action was a violation of the Fair Labor Standards Act.

    That said, if he is issued an IOU instead of pay, I don't think it absolves him of his responsibility to pay his support obligations timely. Give your attorney a buzz to doublecheck.
