    Default Violation 22107 Valid

    My question involves a traffic ticket from the state of: CA

    On 6/1/09 at about 10 pm i was driving to a friends house and i made a right turn onto a street nearby. A police officer was sitting on the other side of the turn, at the exit to a local park. i took the turn somewhat wide when there was no traffic in sight to avoid a pothole that i had previously driven over to prevent potential damage to my car and he proceeded to follow me. I made the right turn onto my friends street and he continued on.

    It turned out my friend wasn't at her house, so i got in my car and turned back onto the previous street. i pulled up to the light and so did the cop, so he must have u turned after letting me go. once the light turned green, his lights went on. I was sighted for unsafe turn and illegal tint.

    My question is, by him letting me continue on and then pulling me over the second time he saw me does it make it ok for him to pull me over for the turn? or did he have to pull me over the first time he saw me for it to be valid? i can understand being pulled over for the tint the second time but how can he justify the turn? and second will the pothole be useable as any sort of defence if i decide to fight the ticket? TIA.

    No, in fact, he could gave just mailed you the citation later on... As long as he is certain that you were driving when he saw you commit the violation, then there is no time limit as to how soon he has to cite you by.

    If you decide to fight it, a picture of the pothole might help but there is nothing in the vehicle code that precludes you from being cited for a lane violation due to a pothole in the road.
