My question involves an injury that occurred in the state of: IL
Hello, I have a strange situation and was wondering if anyone could offer any insight.
In summary, my sister got into an accident some time last year (an oncoming car hit her while she was making a left turn out of a small local street). My sister was hurt and so was the driver that hit her. The insurance companies went at it etc. But the driver who hit her is now trying to sue my sister for injuries. Since the accident, my sister has run off...I believe to europe somewhere, and neither I nor my parents have heard from her since and have no way of contacting her.
At one point, the lawyer representing my sister's insurance co. contacted us asking if we knew where my sister was, to which we said no. The lawyer then told us that someone might try to serve us papers and to not accept the papers if that happens.
Well, today, someone came to the front door of my house and asked if my sister was home and to give her this (the papers). I said she isn't here anymore and that I won't accept the papers. He asked if I was her brother and I said yes. The guy dropped the paper where he stood and walked away saying "you've been served."
Question is, where does this put us, my parents and me? It's only my sister they are suing, but she's nowhere to be found. Can they serve me and legally say that my sister was served? Can they serve me and try to sue me in place of my sister when I have no legal ties with her or the accident? I've seen people saying "never ignore legal papers". But does this still apply in this case?
