    Default Medical Discrimination

    I was a passenger in a vehicle that was rear-ended.
    after the initial ER visit on the night of the accident, when I still wasn't any better a couple of weeks after the accident, I went to
    see my regular doctor (her student doctor actually saw me) but while there I was told that "they" could not be told that the reason I was there was because it was a motor vehicle accident.

    A couple of weeks after this I went back to see my doctor, because I wasn’t any better, where she examined me, but also told me that she would not see me any more because it was a motor vehicle accident. Now this doctor had been my doctor for about 5 years.

    I have had since been turned down by 2 other doctors, when they were told that my “illness” was because of a car accident.

    Is anyone else getting “medical treatment” like this?
    Would this be considered medical discrimination?

    This is in what state? When you have asked them to explain, what have they told you? For example, is it that your medical insurance won't cover the injuries? That they don't want to end up as witnesses in your lawsuit?

    This is for the state of West Virginia

    the doctors (actually it is the receptionists, and you can't get thru the locked doors or the "bullet proof glass") don't give an explaination of why they won't see me. They just say that they don't do motor vehicle accidents.

    But i know that my medical insurance should pay, at least until there is a settlement. In which case they may want to be reimbursed.

    So, it must be that they don't want to get involved in a lawsuit.

    I have been considering asking for a written statement on why i am being refused treatment and if they refuse to give me one, not leaving the doctors office until they call the police.

    Thanks for your help in this matter.

    You were given an explanation. That practice does not treat MVA injuries. When did you notify them that it was a MVA injury? At the time you made the appointment, after treatment, or when your health insurance denied the claim?

    You may be right that they don't want to get involved in a lawsuit and be forced to wait for years before finding out whether they'll be paid.....OR......They've been burned in the past by patients who receive their MVA insurance checks, then spend them instead of paying the Doctor. THEY must then reimburse the health insurance company and attempt to collect from the patient.

    In my experience, your health insurance company will not pay the Physician for an MVA injury. They will request that the patient go through their motor vehicle insurance, until their PIP is exhausted, before picking up any claims.

    It really wouldn't be wise to force the Physician to call the Police to remove you from the office.

    But in the mean time I am doing with medical care, but not without the pain!

    Some how there has to be a way around all of this mess.
    There has got to be something in the law that will protect me from being treated this way.

    What does the PIP stand for?
    I know that we have somehow gone thru our car insurance company and received money for some of the doctor bills, but I don't know what the name of this process is called.

    When was the FIRST time you notified the Physician/office your injury was the result of a MVA? When you called the FIRST time to make an appoint, or when you were already being examined?

    I can understand that the doctor's may have been burned by MVA patients and their reluctance to see me.
    But in the mean time I am doing with medical care, but not without the pain!
    Then perhaps, it's time to find a Physician or facility that is willing to wait and accept insurance payments from motor vehicle insurance companies.

    Some how there has to be a way around all of this mess.
    There has got to be something in the law that will protect me from being treated this way.
    Not unless you're willing to receive care elsewhere.

    Lealea can correct me if I'm wrong but it is my understanding that no health care professional is required to treat you unless you are currently in a life-threatening situation.

    Your recourse is to find a doctor that is willing to treat MVA, NOT to attempt to force this particular doctor to treat you.

    You are correct on both counts cbg.

    I would guess that the Physician documented they were releasing the patient from treatment for this injury.

    sounds like discrimination to me!!!

    sounds like discrimination to me!!!

    No one can force a Physician to accept all insurance plans (MVA & W/C included).

    If you cannot find another private Physician's practice for pain relief, try a walk in clinic.

    Can't help you any further unless you answer the questions I asked above.
