    Default Eviction with Two Rental Agreements

    My question involves an eviction in the state of: Washington

    I rent from my mother and grandmother. My grandmother is not actively managing the property and all intereaction is with my mother.

    We have had in the past had a verbal rental agreement, but my grandmother needed to have a written one to show income. This agreement was written specifically to the requirements she needed. But the understanding between me and my mother was that we would still go by our verbal agreement.

    Recently my mother and I got into an arguement, and she has decided to evict me, because I violated the terms of the written agreement.

    Here are my questions:

    1) While I cant definitely show the verbal agreement I believe I can show that there is a verbal agreement, and that the scenario above is true. What evidence other than emails should I try to get?

    2) I can provide witness's to show that the reason stated on court documents for my eviction is not the actual reason. However these witness's aren't willing to appear with out subpeona. How does one go about getting subpoena's?

    3) Is it possible to get a 2 week extention on this at the hearing? What is the correct way to ask the Judge for this

    4) What other things should I include in my responce?

    I need to file my responce by 7/7/09 @ 430pm.

    The written agreement says you're supposed to do what? You did what instead? You have what evidence of the oral agreement, and that it supersedes the written agreement?

    Written agreement says I am supposed to pay $900/mnth. Actual agreement is that I am to pay $900/mnth when possible.

    Petitioner is claiming that a written agreement has been in effect since 2000. There has only been a written agreement since about 2007. There has been a pattern of allowing me to pay as possible during this entire past 9 years. I have an email, from Petitioner, when they needed the written agreement stating "...of course our actual agreement doesn't change..." However it doesn't state what the actual agreement is.

    I can provide three witnesses that have talked directly with the people whom Petitioner is/was going to have move in, stating that the reason for the eviction is to move them in.

    I have no problem moving, but at this current time, I am unemployeed, I dont have the resources to move currently. All I really want/need from the Judge is a month or so to try to get my feet under me.
