    Default Answering Question Sixteen on Form I-130

    Hello to all forum members,

    My fiancee who is a US citizen is going to file I-130 after our marriage for me. We are getting married in couple of weeks. While scanning through I-130, I am stuck at #16. Because of one reason which is as follows:

    I entered US in 2005, completed my Masters in 2007. I was working on OPT visa till DEC.2008. I applied for OPT extension which is a new rule to extend my visa. But my petition went late and USCIS denied my visa extension. I cam back to India and working here.

    What should i write at #16 in I-130 depending on my case? Please help me guys.

    You were simply denied the extension, and went home at the expiration of your original visa? You were not formally removed/deported?

    If you were only denied the extension, I would answer No.

    Obviously, you should check with an immigration attorney to be sure, or have your fiancee do so.
