    Default Defandant in an Assault Case Commits Suicide Before Court Date, What Next?

    My question involves criminal law for the state of: Maryland

    So about a month ago, my friend was drunk and he decided to beat me up, a good close friend. I told him he would have to give me some money for me to deal with it, or else i'd contact authorities. This isnt the first time he's attacked me when he was drunk, so when he decided not to give up some cash, I went and filed an assault report.

    His girlfriend, roomate, and two other girls were there who witnessed the attack. They all told him to stop and they helped control his drunken rage. After that day I decided he wasnt a friend anymore.

    Fast forward two weeks, I get news from a friend that he shot himself! I talked to his girlfriend and it's confirmed. His facebook is now a memorial page

    What happens now? The only evidence I've got is a voice recording of a phone conversation where he admits that he got mad over something I said. (we were having a non hostile debate). I haven't even gotten the court date letter in the mail yet and no one has called me. How long is that stuff supposed to take?

    He is dead. Just what do you expect the court to do at this point? Why do you care? You are guaranteed not to be assaulted at this point.

    NO SHIT SHERLOCK, I know I'm not going to be assaulted again. I know he's dead, you don't need to remind me. I have no idea what the court is going to do. I've never been to court before. I care because I'm curious, and thus I registered on this forum and posted. If you don't have any useful input, why reply?

    What do you expect them to do at this point? Use your head. It isn't like they are going to dig up his dead body and throw it in prison. No need to personally attack others when you ask questions like that. What input do you expect?

    There is no defendant ... there is no person to prosecute.

    The matter will be dropped.

    Oh, and by the way, you should probably be thankful that it is not going to trial - your little threat to report him to the cops if he didn't pay you cash to keep silent is called "extortion". Be thankful that his misdemeanor did not turn into your felony.

    based on your behavior, attitude and your user id, I can see why your friend would want to be the living daylights out of you. Sounds to me, like your upset that you lost your chance to commit extortion. At any rate, he's dead, so you won't be getting any money out of this. He got away with beating your ass.
