I received a judgement for back child support in Texas in 1997. Long story, but short version is that when decree was verbalized in court in another state the decree was never entered or signed and I continued to pay the temporary amount thinking that would force ex to get her attorney to get the document signed and filed. Didn't work like that and after she refused visitation, I got the decree from her attorney and took it to the judge to sign and got it filed myself.
The visitation issues continued and we went to court. At the hearing she was able to obtain a judgement for the difference between what the court awarded and the temporary support I continued to pay until the decree was filed. We had a strong argument, precedents, etc. however she prevailed on the judgement matter. So I agreed to pay $100 per month over 24 months to settle the arrearage. I have done so and have the proof a file stamped copy of the register used to record the child support payments.
We lived apart in adjacent counties and then she moved into the same county at which point the denial of visitation continued to the point that I hired an attorney. After a cross complaint seeking a modification, the primary issues were worked out and jurisdiction was transferred to Bexar County however I changed jobs and the order for witholding from earnings came into effect.
The judgement from Kendall County was transferred and somehow became recorded into the record of the AG as a judgement but the record of payment was not. Kendall County had it's own child support registry at the time and was not hooked into the state system.
I met with a lawyer at the AG Child Support office in San Antonio and even though they have the same information, the spreadsheet that Kendall County recorded my payments on which shows the excess for payment of the judgement, they did not care and stated that it was better for the child and that if I wanted to do something about it I could go to court. They did not want to help me at all to remedy the matter and so now this shows on my credit report as a judgement in arrears.
Does anyone have any idea how I can go about getting this resolved? What kind of petition would be involved or what would be the process to resolve this through the courts?
