    Default Incorrect Lien on Residence

    My question involves real estate located in the State of: Idaho

    I had a materialmans lien place on my property and also listed in a civil lawsuit regarding a general contractor for an unpaid debt. I did not have any relationship with the Contractor and finished building my house approximately 3 years ago, in which I was the general contractor.

    I live in a small subdivision and have a common last name with another family that is having problems with the contractor listed in the lawsuit. I was mistakenly identified as the property owner of the residence having the issues with the contractor. My property (legal description included) had the lien placed on it and my wife and I were listed in the lawsuit.

    I have been able to have the lawsuit dismissed and the lien removed, however is there any course of action for a countersuit to the company that libelously included me and my wife in this suit and placed a lien on my property without cause?

    Actually an improperly placed lien would be slander of title from my own personal experience. In the end it did me no actual monetary damage and unless you have provable (in court) monetary damages, you are done with it.

    If you feel that you have additional damages that you can prove, get the advice of a local attorney.

    Thanks for the reply. I am more concerned with the affect on my credit score. I have spoke with others who have stated it can affect a credit score even once it is removed.
