    Default Bench warrant problem in Ohio

    in 1999 I took a couple of packs of cigarettes from krogers and got caught, 1st time offense. around that time a death had happend in the family and I was not able to go to my court date and completly forgot about it. now the problem is I went to a online site and seen that I have a bench warrant, which kinda confused me a little because I just got a speeding ticket in July and the cop let me go no questions asked. I am wanting to get the warrant taken care of, how should I go about doing this? do I just go to court and pay a fine? any help will be greatly appreciated.

    I would suggest calling the court to find out what the bail amount is and confirm the warrant with the court. Then you can make a better game plan to clear it up.

    I don't know if going to the court would be your best way to go about this. I have heard of an instance when someone went to pay overdue parking/traffic violations, and when he told the clerk his name, the clerk asked him to wait one moment and she went to the back, then a few minutes later a police officer was behind him arresting him...Doesn’t mean this would happen in your case. I am not even sure what a bench warrant is to be exact, but I thought I’d just fill you in on that bit of information.

    ok I called the court, and they say I need to go there in the morning and asked to be added to the court in the morning.

    "A bench warrant is a variant of an arrest warrant which authorizes the immediate arrest on sight of the individual in question who is in contempt of court possibly for failing to appear at the appointed time and date for a scheduled court appearance." That is the deffinition of bench warrant that wikipedia.com has. Sounds like you could be arrested when you go to the court, but given the fact that you did not intentionally miss court(according to your story) they may decide not to arrest you.
