you can put your last name on the BC
you do not have to put the fathers name on the BC. In fact, you cannot put the putative fathers name on the BC unless he acknowledges paternity or it is accepted via the courts that he is the father.
and yes, you can sue him for CS and part of that will be the determination of him being the father and then it can be put on the BC. I do not know if Texas courts automatically order the fathers name be placed on the BC or if somebody has to pursue it outside of the parental determination.
And this has nothing to do with emancipation laws.
