    Default Child Support Limitations

    My question involves child support in the State of: California

    My divorce paperwork was drawn up 9 years ago with the stipulation that my ex and I would pay child support by agreement. There were never any orders drawn by the court. I have been paying for 9 years now with my payments escalating by agreement to 275.00 every 2 weeks. My oldest is now 18 and has graduated from High School. My ex makes about 25% more than I do. My question is can she try to get back childsupport if I cut the payments in half or would I just have to continue to pay half for my 16 year old until he is 18.

    I am not familiar with the legalities of paying "by agreement". Sounds like a recipe for disaster. Are you sure nothing is stated about when CS ends???

    I suggest you see what the actual legal guidelines would be for two children vs. one child. The amount probably is not reduced by exactly 50%. Once you know what you could be paying you should legally modify the agreement with your child's mom.

    We never had support papers drawn. I was not working at the time so I just paid what I could. The divorce paperwork states "by agreement and that the court reserves the right to draw papers if necessary." Since she has cashed all the checks and the checks clearly state that it was for and the dates it was through, and she never challenged it over the last 9 years, do you think there is an issue??
