    Default Losing Deposit

    My question involves a security deposit in the State of: California

    I moved out to California about three weeks ago. In doing so, i rented a room from what seemed to be a nice couple. I gave them a $200 deposit that they requested from me. I never signed any leases.

    Now I want to move out and told them a week in advance of my decision. They said that i had to give them atleast a thirty day notice by california law and because i didnt they are going to hold my deposit from me. I had told them that it would be impossible for me to know the day that i moved in that i was going to move out the next month. but they just nodded and said too bad. Also they went on vacation on the 10th and came back a few days ago. The minute they got back i told them that i want to move out.

    My question is what is California Law regarding this subject and is it possible for me to get back my deposit through legal means?

    Any help is much appreciated. The money may not seem like a lot but i recently lost my job and am living off my savings and right now every little bit helps. Thank you again for your help.

    In absense of a written lease, CA law requires that you give and pay for a full 30 days. Be thankful that the landlord is letting you use the security deposit in lieu of rent paid.
