My question involves criminal law for the state of: SC
My stepson (30) came to live with us for one week.
He has always been a loose cannon and has a rap sheet a mile long (weapons charge, burglery, shoplifting, etc) but had just gotten off probation and was trying to get his GED and we really thought he was trying to change so we let him stay with us.
On Tuesday night he was riding with my son (14) and his friend(17) out to see me at my job. On the way back home my stepson told them to pull into a gas station so he could get cigarettes. My son noticed people running out and when he looked in the window, my step son was behind the counter with a gun pointed at the cashiers head. (The gun ended up being a bb pistol--stupid!)
Anyway, the next day my son and his friend went to the police station to talk to them about what happened. The 17 year old was arrested after his statement and my son was released to me but they said he is being charged. (no fingerprints were taken-this was just a police substation area). Anyway, he said the docket for Juvi court is so backed u p that it could be months before we hear anything.
They found my stepson (with our help) about 4 hours later and he is now in jail. They also found the gun because my son told them where stepson hid it at a stop sign.
I am scared to death for my son. Other than trouble in school, he has never been in any trouble with the law. I am wondering what we "could" be looking at as charges.What's minimum he could face and maximum? He feels so bad for his friend as do I. We have already talked with the cashier. I felt so bad for him.
