    Default CVC 21658(A) - Unsafe Lane Change Ticket

    My question involves a traffic ticket from the state of: California

    I was pulled over driving 70 in a 70mph zone. (The officer wrote 65 on the ticket for some reason) and got pulled over for an unsafe lane change.

    It was a two lane freeway and I saw some headlights come from far away and pull up to my bumper about a minute or two after I cut lanes. This happened to be the CHP.

    What he said was, I cut to the left lane and caused him to brake hard. I told him that I flashed my blinkers for well over 100 feet and saw that there was no car to my left. There indeed was no car and he is in fact making everything up. However he wouldn't take no as an answer and pretty much forced me to sign the ticket since I would probably be in bigger trouble if I didn't sign.

    He also admitted that he saw me blink my turn signals, i have a feeling that he was going well over 70 mph and by cutting to the left lane on a two lane road I may have unknowingly pissed him off because he was blocked. He did not have lights and sirens on or anything so I didn't know he was a police officer when he was approaching really fast to the back of my car. I thought it was just a person trying to speed.

    Can anyone help on how to fight this case? I think his patrol car camera may actually prove me innocent since you will see me merging onto the left lane way before the officer is even near my car. But what are my chances of even being able to see that footage or use that footage in court?

    To show that you were impeding the normal flow of traffic by driving slower than the speed limit.

    Just because you signaled for 100 feet does not fully satisfy the requirement. You must also clear traffic no only to your left, but traffic that is approaching from behind.

    Signing the ticket is not an admission of guilt. It is merely a promise to appear on the date/time shown. By refusing to sign it, he had the option to cuff you and take you in.

    He does not have to drive at the speed limit nor does he have to have his lights and sirens on if he is on his way to a call. Officers are often required to go to a call without using lights and sirens depending on the circumstances.

    So rather than waiting until he passes, you decided to "cut lanes" to stop him from speeding?

    How do you know that his car has a video camera and even if it did, how do you know it was on at the time?
