    Default Juvenile Shoplifting= Not Searchable in Records by Employer?

    After reading much on the internet through these $$$ background searches, it seems that they cannot get juvenile records? E.g., shoplifting would be a misdemeanor, and you can only do county searches for misdemeanors?

    From my previous post, my friend was 16, he is now almost 20, and he is in MASS, and got an offer at a job, but they are doing a background check.

    And in Massachusetts, you can't expunge that record, only seal correct? I am wondering if we should pay the money for a criminal search.... like all those places doing it for $15-40.

    Any advice?

    Default Did a criminal bg check online: NCRPR.org

    So, after $18.95, on an instant background check, it seems like there's no record of that. How reliable do you guys think online background checks are? or ncrpr.org in general .... since employers would probably use the same background check, I assume that my friend can just check "no" under criminal offenses?

    Default Massachusetts Criminal Record

    According to the Massachusetts State Bar
    Quote Quoting Criminal Record Law
    Juvenile criminal records may be sealed 3 years after conviction, if an individual has not been convicted of any criminal offense in the interim. A person with a sealed record may answer "no record" to any question on an employment application concerning his sealed record. Massachusetts law also forbids employers to ask about juvenile records, misdemeanors more than five years old if the applicant has no convictions in the interim, a first conviction for certain minor offenses, and any arrests which did not lead to conviction.

    Also, I received this email to my question that I asked the background checker:

    Hello [tbbw],

    Thank you for your email.

    As far as we are aware no local agency (police departments, department of
    corrections and various courts) is allowed to report on Juvenile records, if crimes
    were committed before the age of 18, even if the subject is now over the age of 18.
    These type of offenses are normally sealed. The only way we know of that an employer
    could find these information it by a court order.
