    Default Friend caught shopping lifting at 16; no mail, no court,

    Hi everyone:

    Well here's the situation: My friend has been offered a job, but they are doing a background check on him right now. He's really worried since he did a stupid thing when he was 16 (he's 20) now, when he shoplifted parts at a computer store, worth about $100 or less. He didn't even attempt to leave the store or anything.

    Anyway, I guess what happened is that a police officer came to take him, if his parents didn't come. His parents paid for all the items stolen, and he couldn't come back to the store (either ever or 1 year). He didn't have any ID on him, and nothing was photocopied, but he wrote down his birthday, and got photographed.

    He never went to court either or got anything in the mail like a civil citaiton (or something)? So, I was wondering if this is a minor record that employers can't find.. or should he pay $30 to get his records checked or something?

    It isn't clear if he was ever charged. If he was it was likely as a juvenile, and depending upon where the incident occurred his record may have been automatically sealed, or may be subject to being sealed if he files a petition with the court. If he never went to court, presumably he was never charged and there would be no court record or conviction.

    From what I've been learning so far, I guess he never was charged for it. The products were paid for and he had a good scare.

    I think the juvenile records were probably automatically sealed. aaron in my other post quoted the Mass bar.

    I'll tell him to research how to petition for a seal if it's not automatically sealed.
